TERMS AND CONDITIONS
In addition to the terms and conditions outlined below please see our covid-19 rebooking/refund policy.
We reserve the right to terminate a booking at any time if any of these conditions are not met.
1. BOOKINGS
1.1. A binding contract between you (the person booking the accommodation) and us (the owners of Duirinish Holiday Lodges) will arise when we have received a payment from you for either the required booking deposit or payment if full as per the booking quote AND you subsequently receive a written booking confirmation from us. These terms and conditions are binding to you and all guests under your booking.
1.2. Please check this booking confirmation carefully and contact us if any of the information you receive appears to be incorrect.
1.3. The minimum age of the hirer should be 18 years.
1.4. We reserve the right to refuse to accept any booking for whatever reasons. If we refuse a booking after payment has been made a full refund will be issued.
1.5. Provisional bookings made by you via telephone or email and accepted in writing by us must be secured by you within 72 hours of our acceptance see: Payment. Provisional booking that are not secured within 72 hours will be considered cancelled.
1.6. The Lodge will be available from 4pm on the day of arrival to 10am on the day of departure.
1.7. Included in the accommodation cost is all, heating, electricity, bed linen, towels and VAT. Excluded are any onsite extras e.g. usage of the laundry facilities. Wireless internet is available in our lodges free of charge and subject to technical availability.
1.8. Further access details and directions will be sent to your via the guest portal prior to your stay.
2. PAYMENT
2.1. If booking is made more than 30 days before your arrival date your reservation must be secured with a non-refundable deposit payment of 25% of the quoted accommodation price.
2.2. Deposits are not refundable in the event of your cancellation or failure to pay the balance of the booking.
2.3. The outstanding balance must be paid 30 days prior to your arrival. Your booking shall be deemed cancelled and the lodge is available for re-letting should the outstanding balance not be paid by this date.
2.4. If booking less than 30 days before your arrival date your reservation must be secured with a full payment of the quoted accommodation price.
3. INSURANCE
3.1. We advise you to take out holiday insurance with a third party to cover any loss or damage you may incur.
4. CANCELLATIONS
4.1. In the event of cancellations by you we will retain your deposit.
4.2. If the full balance payment has been made then refunds of that balance (less the deposit) will only be given if the accommodation is re-let. All refunds will take into account any discounts given in order to re-let the accommodation.
4.3. In the unlikely event that we have to cancel/amend your booking (for reasons such as fire or flooding), we will advise you as soon as possible and endeavour to offer you alternative accommodation or alternative dates. If this is not possible, a complete refund will be given.
4.4. Our liability for cancellation will be limited to payments made to us
5. ALTERATIONS TO BOOKINGS
5.1. If you require an alteration of your booking please contact us directly to discuss.
6. GUESTS RESPONSIBILITIES AND FORFEITURE
6.1. The guest’s right to occupy the lodge may be forfeited without compensation if:
6.1.1. More pets than declared to us at the time of booking and/or guest occupancy numbers exceed the stipulated guest allowance on the lodge listing.
6.1.2. Additional overnight guests are entertained without our express permission.
6.1.3. Any activity is undertaken which is illegal, or may cause unreasonable damage, noise, behaviour, or disturbance
6.2. Any guest using their own electrical appliances (hairdryers, curlers, tongs, shavers, personal computers, personal stereos etc.) must use the appropriate adaptor. Non-UK plugs used without the appropriate adaptor/transformer are a serious fire risk.
6.3. You accept that the letting is a holiday let to which paragraph 6 of Schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016 applies. You shall not sub-let any part of the lodge.
6.4. Please ensure that all heated appliances including the provided portable heaters are switched off and stored safely before leaving the apartment. The provided fixed electric heaters may be left turned on at a reasonable level when you are not in the property.
6.5. Unless otherwise agreed, we will issue to the guest one set of keys to the property. If at any time the guest loses the keys, they must notify us as soon as possible and we will instruct a locksmith to change the lock/key(s) and charge you.
6.6. We cannot be held responsible for any failure or interruption to services to the property, for example, gas, water and electricity, or for any damage, disturbance or noise caused as a result of maintenance work being carried out in any part of the lodge.
6.7. Breakages/damages to the Lodge or its contents should be reported to allow time for repairs or replacement before the next guests arrives. We reserve the right to charge for damage or breakages.
6.8. Motor vehicles, bicycles and boats are parked on site at the owner’s risk, and no responsibility will be taken by the proprietor for any damage or loss.
6.9. All Lodges are strictly non-smoking. Smokers must vacate the lodge should they wish to smoke. Where there is evidence of guests smoking within the apartment, we reserve the right to charge £200 for specialist cleaning, payment will be debited from your debit or credit card for your reservation.
6.10. The properties are cleaned before letting. However, you are responsible for keeping and leaving the property in reasonable clean and tidy condition. Please remove dirty shoes when you enter the lodge
7. PETS
7.1. Dogs are very welcome, but must be kept on a lead at all times whilst on the site, and never left alone in the Lodge. If you are bringing a dog there is a small additional charge which allows a maximum of 2 dogs. In the interests of hygiene they are not allowed on the furniture and we would ask you to bring bedding with you for the dog to sleep on. As children play around the Lodges dogs must be exercised off site. Dogs must be at least 6 months old and booked in advance.
8. ACCESS TO THE LODGE DURING OCCUPANCY
8.1. In the event of essential maintenance or repairs we the owners or our representative shall be allowed access to the Lodge after reasonable effort has been made to contact you and or the guests.
9. VAT
9.1. Our VAT Number is 360 1784 08
10. FORCE MAJEURE
10.1. We cannot accept liability in any circumstances where performance of the contract is prevented by reason of: war or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action or any similar events beyond our control.
11. LEGAL
11.1. Any dispute claim or other matter which may arise in relation to your booking will be governed by Scottish law and you agree that any dispute will be dealt with exclusively by the courts of Scotland
